Terms of Service

1. Acceptance of Terms

By accessing or using the services offered by Sploothy ("Company," "we," "us," or "our"), including but not limited to the creation, purchase, or receipt of custom digital or physical sticker products (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use our Services.

2. Eligibility

You must be at least 18 years old or have parental/guardian consent to use our Services. By using our Services, you represent that you meet these requirements.

3. User Content and Responsibilities

You are solely responsible for any text, images, or other content ("User Content") you upload, submit, or request for use with our Services. By providing User Content, you represent and warrant that:

  • You own or have all necessary rights to the User Content.
  • The User Content does not infringe or violate any third party's intellectual property, privacy, publicity, or other rights.
  • The User Content does not violate applicable laws or regulations.

You grant us and our print-on-demand partners a limited, non-exclusive, royalty-free license to use your User Content solely for the purpose of fulfilling your order and providing the Services.

4. Intellectual Property Compliance

We respect intellectual property rights and require our users to do the same. You agree not to upload, submit, or request content that infringes upon any third-party copyright, trademark, or other intellectual property right. We reserve the right to reject, cancel, or remove orders that, in our sole discretion, appear to involve infringing content.

5. Orders, Payments, and Refunds

Payments are processed securely through third-party processors (e.g., Stripe). We do not store or have access to your full payment details.

Refund Policy:

  • Customer-initiated cancellations: Because our products are custom-made, we generally cannot accept order cancellations once production has begun.
  • Full (100%) refunds are provided for defective products where the defect was not reasonably apparent in the generated design preview (e.g., print defects such as blurring, misalignment, or damage).
  • Refunds for dissatisfaction not attributable to a clear defect will be considered on a case-by-case basis at our discretion.
  • Examples of refund-eligible defects include, but are not limited to: misprints, material flaws, or shipping damage.

We reserve the right to cancel any order at our discretion, including due to destination restrictions. If an order is canceled, you will receive a full refund.

6. Shipping and Fulfillment

We work with third-party fulfillment providers (e.g., StickersAndPosters) to produce and ship physical products. Orders are typically processed within 1 business day, then produced and shipped within an additional 1–2 business days. Delivery times may vary based on location and carrier.

7. Limitation of Liability

To the maximum extent permitted by law, our liability to you is limited to the amount you paid for the relevant product or service. We are not liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, goodwill, or data.

Sploothy is not responsible for any damage to surfaces, including but not limited to paint, walls, vehicles, electronics, or personal property, resulting from the application, use, or removal of our products. All products are applied and removed at the customer's own risk.

8. Indemnification

You agree to indemnify, defend, and hold harmless Sploothy, its officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your User Content, use of the Services, or violation of these Terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in California.

10. Changes to Terms

We may update these Terms from time to time. Continued use of our Services constitutes acceptance of the updated Terms.
